These terms govern your use of this website. By browsing it you accept them. If you do not accept them, please stop using the site.

1. What this website is

This website is published by Yale Landing, the retail centre at 2500 Yale Blvd SE, Albuquerque, NM 87106. It exists to tell people what businesses operate here, roughly when they are open, and how to find the property. It also carries information about space available to lease.

It is an informational website. It is not a booking system, an ordering system, or a place where you can enter into any agreement with us or with any business at the property.

2. Information is provided “as is”

Everything on this site is provided for general information only, on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law we disclaim all implied warranties, including any warranty of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

In particular, and without limiting the above:

• Opening hours change without notice. A business may close early, open late, close on a holiday, close for a private event, close temporarily, or cease trading altogether. We do not monitor this in real time.
• Menus change without notice. Items shown may be seasonal, discontinued, sold out, or reformulated.
• Prices are not shown on this site, and where any figure does appear it is not a quotation. Pricing is set entirely by each business.
• Photographs may not depict current conditions. Some images on this site are artist’s renderings and are labelled as such. Renderings are conceptual, are shown for illustration only, and do not depict existing improvements, completed construction, or committed tenants.

We do not warrant that the site will be available without interruption, that it is free of errors, or that any defect will be corrected.

3. Third-party businesses and their content

The businesses at Yale Landing are independent operators. They are our tenants. They are not our agents, employees, partners, or joint venturers, and we do not control how they run their businesses.

Menus, hours, dish descriptions, product lists, telephone numbers, logos, trade names and trademarks shown on this site belong to those businesses or to their respective owners. We display that information as a convenience, drawn from what each business has itself made public. We are not the author of it and we do not adopt it as our own.

Any transaction you enter into with a business at this property is between you and that business. We are not a party to it. Any complaint, refund request, allergy question, service issue or dispute should be taken up with the business directly.

All third-party names and marks are the property of their owners. Their use here is descriptive and does not imply endorsement of this site by them.

4. No professional advice

Nothing on this site is legal, financial, investment, real-estate, tax, medical, nutritional or dietary advice, and it must not be relied on as a substitute for advice from a qualified professional. If you have a food allergy or a dietary restriction, speak to the business directly before ordering — do not rely on anything written here.

5. Leasing information is not an offer

The leasing pages and any brochure, floor plan, site plan, rendering, square footage, rate, term or specification made available through this site are marketing material only. They are not an offer, an invitation to treat capable of acceptance, a representation, or any part of a contract.

Measurements and areas are approximate and subject to verification. Availability, rates, terms, configuration and specifications are subject to change or withdrawal at any time without notice. No lease, licence or other interest in the property arises except under a written agreement signed by the property owner. Prospective tenants must satisfy themselves by their own inspection, survey and professional advice.

6. Limitation of liability

To the fullest extent permitted by law, neither Yale Landing nor its owners, members, managers, employees, agents or contractors will be liable for any loss or damage of any kind arising out of or connected with your use of this site or your reliance on anything in it. This includes, without limitation:

• a wasted journey, including travelling to the property to find a business closed, relocated, or no longer trading;
• an item being unavailable, discontinued, sold out, or differently priced than you expected;
• lost time, lost profits, lost opportunity, lost data, or business interruption;
• any indirect, incidental, special, consequential, exemplary or punitive damages;
• any act or omission of a business at the property or of any other third party.

This applies regardless of the legal theory relied on — contract, tort, negligence, strict liability, statute or otherwise — and applies even if we have been advised that such loss was possible.

Where liability cannot lawfully be excluded, our total aggregate liability to you for all claims arising out of or relating to this website is limited to one hundred United States dollars (US$100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations above apply only to the extent permitted, and nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

7. Links to other websites

This site links to external websites, including tenant websites, mapping services, ordering platforms and social media. We do not control those sites, we are not responsible for their content, accuracy, availability, security or privacy practices, and a link is not an endorsement. Visiting them is at your own risk and subject to their terms.

8. Our own content

The design, layout, written copy, photographs commissioned by us, and the Yale Landing name and logo are protected by copyright and trademark law. You may view, print and share pages for your own personal, non-commercial use. You may not copy, republish, scrape, mine, mirror, frame, or use this content to train a machine-learning model, or use it for any commercial purpose, without our prior written permission.

9. Acceptable use

You agree not to use this site unlawfully; not to attempt to gain unauthorised access to it or to any system connected to it; not to introduce malicious code; not to place unreasonable load on it through automated requests; and not to use it to harass any person or business.

10. Changes

We may change the site, and these terms, at any time. The version published here is the version in force. The date at the top shows when it last changed. Continuing to use the site after a change means you accept the revised terms.

11. Governing law

These terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-law rules. The state and federal courts sitting in Bernalillo County, New Mexico have exclusive jurisdiction over any dispute arising out of them.

12. Severability and entire agreement

If any provision of these terms is held unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed, and the remaining provisions continue in full force. Our failure to enforce any provision is not a waiver of it. These terms, together with the Privacy Policy and Disclaimer, are the entire agreement between you and us regarding this website.
